Terms and Conditions of Business for the Supply of Permanent Personnel

These Terms and Conditions of Business are between Jobsearch North West Ltd, 25 Bridge Street, Burnley (hereinafter called “Jobsearch” ) the Employment Agency and the Employer ( hereinafter called the “Client” ) and are deemed to be accepted by the Client by virtue of an interview or the engagement of a Permanent Employee ( hereinafter called the “Employee” ) introduced by Jobsearch.

1. The Client agrees: (a) to notify Jobsearch immediately an engagement is accepted and (b) to pay the fee payable to Jobsearch by the Client (hereinafter called the “Placement Fee”) for the introduction of an Employee within THIRTY DAYS of the commencement of the engagement.

2. The placement Fee payable to Jobsearch by the Client for the introduction of an Employee will be confirmed at the time of introduction and/or enquiry up to a maximum charge of £1500.00 plus vat.

3. In the event of an Employee leaving the Clients employment within 8 weeks of commencement the placement Fee will be refunded in the same proportion as the un-worked period has to 8 weeks provided that Jobsearch is notified by the Client in writing within 7 days of termination of employment and provided that the Client has paid the Placement Fee within 30 days of the date of invoice. Should the Client or any subsidiary or associate company of the Client subsequently re-engage the Employee within the period of 12 calendar months from the date of termination a full Placement Fee in accordance with Paragraph 2 above becomes payable.

4. Introductions are confidential. The passing on of an introduction to another employer which results in an engagement renders the Client liable to payment of the Placement Fee.

5. A Placement Fee will be charged for any Employee engaged as a consequence of, or resulting from an application to Jobsearch, even though the introduction is made indirectly.

6. Jobsearch endeavours to make every reasonable effort to ensure the suitability of the Employee selected on behalf of the Client but cannot accept responsibility for any loss, expense, damage of delay, however occasioned. The Client is responsible for taking up references concerning an employees skills, qualifications and general integrity, obtaining work permits and satisfying any medical requirements or qualifications as required by law.

7. Jobsearch reserve the right to charge interest at Bank Base rate on accounts overdue.

8. Alterations to these Terms of Business can only be accepted if confirmed in writing by Jobsearch.
